These General Seller Conditions govern the relationship between:

The Seller (as defined in the Definitions below) using the Site to sell Items.

Preamble

MVEGAS COMPANY develops and operates the electronic website CIRCULAR CLOTHING PARIS (trade name) accessible at the URL addresses: https://www.circularclothingparis.com https://www.circularclothingparis.fr https://www .circularclothing.fr (hereinafter the “Site”).

The Site is accessible to all Users of the Internet network in principle 24/24h, 7/7d, except interruption, scheduled or not, by MVEGAS COMPANY or its service providers, for the needs of its maintenance and/or security or case of force. major.

MVEGAS COMPANY cannot be held responsible for any damage, whatever its nature, resulting from the unavailability of the Site.

MVEGAS COMPANY does not guarantee that the Site will be free from anomalies, errors or bugs, nor that the Site will operate without failure or interruption. In this regard, he may freely and at his entire discretion determine any period of unavailability of the Site or its content.

Nor can MVEGAS COMPANY be held responsible for problems with data transmission, connection or unavailability of the network.

MVEGAS COMPANY reserves the right to make the Site evolve, for technical or commercial reasons. When these modifications do not substantially and negatively alter the conditions of the provision of services, the User may be informed of the modifications made, but his acceptance is not requested.

 

Definitions

The Parties agree and accept that the following terms used with a capital letter, in the singular and/or in the plural, have within the framework of these “General Seller Conditions”, the meaning given to them below:

“Buyer”: designates any User, who buys one or more Item(s) on the Site

“Item”: designates any Fashion Item and/or relating to fashion and beauty offered for sale on the Site

"Order": commitment to purchase all the Items selected by the Buyer via the Site's e-commerce service.

“Seller Contract”: refers to these General Terms and Conditions of Sale

"Item Sheet": designates all the information detailing as closely as possible the conditions of the Item offered for sale

“Seller Fee”: amount collected by MVEGAS Company in return for the sale of an Item by a Seller.

Shipping costs: shipping costs set by MVEGAS Company, based on the rates of shipping services according to the Delivery Method chosen by Users.

“Information”: data (personal, professional, information, etc.) posted by any User on the Site;

“Account”: page dedicated to a User registered on the Site containing the Information provided by this User;

"Delivery": delivery means the transfer to the Buyer of the physical possession of the Item(s)

“MVEGAS COMPANY”: MVEGAS COMPANY, Simplified Joint Stock Company with share capital of 1,000 Euros, registered with the PARIS Trade and Companies Register under number 907 994 487, whose registered office is located at 39 RUE STEPHENSON 75018 PARIS

"Basket": the Basket summarizes the Items chosen by the User as well as the prices and costs relating thereto

“Price of the Item”: price offered by the Seller for the sale of an Item. It constitutes the basis for calculating the Commission and Seller Fees of MVEGAS Company. It does not include shipping costs, vouchers, discount vouchers or any other reduction.

“Site”: website published by MVEGAS COMPANY and accessible at the addresses

“Transaction”: means the price paid by the Buyer to acquire the Item in return. It includes the Price of the Item, plus Shipping Costs.

"User": refers to any Internet user browsing the Site in any capacity whatsoever (Purchaser or not, natural person acting in his or her personal name or on behalf of a legal person, Internet user not registered on the Site, Professional Seller or not etc.)

“Seller”: User who offers one or more Item(s) for sale. It can be either an individual or a professional.

“Professional seller”: User acting within the framework of his professional activity or a commercial activity which offers for sale one or more Item(s).

MVEGAS Company offers on its Site the services provided and administered by MVEGAS Company. These services allow " Sellers " on the " Site " to sell and buy second-hand fashion items (the " Items ").

These “ General Seller Conditions ” shall prevail over any other general or specific conditions not expressly approved by MVEGAS Company and the User.

By using the services of MVEGAS Company, the Seller accepts the terms and conditions of Stripe, which is the payment provider retained by MVEGAS Company for Sellers' payment transactions. These Terms and Conditions are available here .

Seller's General Conditions applicable to sales made on the Site

1. Role and responsibility of MVEGAS Company

The Sellers recognize that, unless otherwise indicated in the context of the offer of the Articles, the role of MVEGAS Company is to provide intermediation between Users. As such, except in specific circumstances or cases, MVEGAS Company is not a reseller of the Articles and does not, at any time, become their owner. Each Seller acts, at all times, in his own name and for his own account and in no way acts as an agent or representative of MVEGAS Company. MVEGAS Company is not a party to the sales contract concluded between the Buyer and the Seller and does not assume any liability originating from such a contract or arising from this sales contract.

The quality control potentially carried out by MVEGAS Company relates only to the adequacy of the Seller's Article to the description given in the Article Sheet filled out by the Seller. In addition, the delivery potentially carried out by MVEGAS Company through its subcontractors does not make MVEGAS Company a party to the contract between the Seller and the Buyer.

With the exception of disputes for late or non-delivery of Items attributable to MVEGAS Company, it is the Seller's responsibility to respond to any dispute or claim relating to the Items they have posted, their description and the comments of any User. on the Item Sheet, and/or the shipment of the Items by the Seller (whether this shipment was made in the context of the sale, exchange or return of the Items), and any dispute or claim of this order will be redirected to the Seller who will assume full and sole responsibility.

2. Sale of Items

2.1 Mandate

As part of the online intermediation service provided by MVEGAS Company, the Seller agrees to entrust MVEGAS Company with a mandate to carry out the following:

  • publish on the Site the Item Sheet which constitutes an offer to sell, with all the content inserted by the Seller, and if necessary, make changes to the photographs of the Item, within the limit of simple clipping;

  • accept the Buyer's Order, in the name and on behalf of the Seller;

  • receive, in the name and on behalf of the Seller, the sums paid by the Buyer under the Transaction;

  • open, in the books of MVEGAS Company, in the name and on behalf of the Seller, an agent account on which to credit the Price of the Item; And

  • receive and transmit to the Seller the sums mentioned above, less the Seller Fees and any other amount applicable in the event of sums remaining due, as provided for in Articles 5, 6 and 8 hereof.

2.2 Creation and modification of the Item Sheet

 

Creation of the Item Sheet

Each Article that a User wishes to offer for sale must necessarily be the subject of a written Article Sheet. The Seller must precisely describe all the different characteristics of the Article and mention its Price on the Article Sheet.

The characteristics of the Article mentioned in the Article Sheet, and in particular the condition of the Article, correspond to the characteristics as declared by the Seller before verification by MVEGAS Company.

The Items offered for sale must be available and can be ordered by Buyers as long as the Item Sheet appears on the Site. A Seller may at any time permanently remove a referenced Article from the Site if this Article has not been the subject of an Order, by deleting the Article Sheet.

The Seller undertakes to describe in a complete, sincere and faithful manner the Article both in its characteristics and its brand, and, where applicable, in the presence of faulty workmanship, deterioration or wear, or any other attribute of the item that a Buyer would reasonably wish to know about when purchasing said Item. He refrains from distributing a modified representation of the Article. In the event that an Article has undergone an aesthetic transformation before it is put on sale (personalization, customization, etc.), the Seller undertakes to indicate this explicitly in the Article Sheet.

In order to guarantee the consistency of the Items offered for sale on the Site, MVEGAS Company reserves the right to accept or refuse a Seller's Item Sheet before it is posted on the Site. In case of acceptance of the Article Sheet, MVEGAS Company will send an email to the Seller relating to the Price, specifying the amount of the Seller Fees that will be included in the Price.

Modification of the Item Sheet

The Seller may add comments in the space provided for this purpose. He can also add additional photos of each Article referenced, after the publication of the Article Sheet on the Site. Any addition of images will be subject to validation by MVEGAS Company.

These changes to the Item Sheet do not apply to Transactions in progress (i.e. after the Order has been placed for the item by the Buyer).

The Seller has the option of lowering a Price, in which case the Seller Fees of MVEGAS Company may be subject to an adjustment in accordance with the scale of Seller Fees as described in Article 5 hereof and the old Price may appear crossed out on the Master record.

MVEGAS Company may propose an evolution of the Price in order to make it consistent with the price of other Items referenced on the Site and, in general, with market expectations. The Seller therefore agrees to discuss in good faith with MVEGAS Company the level of the Price. Any modification of the Price by MVEGAS Company is only effective upon acceptance by the Seller.

Throughout the listing process, the Seller has full visibility of the Price and the associated Seller Fees. Before the sale of its Article or the reduction of the Price of the article, the Seller must confirm, on each occasion, that it accepts the Price and the Seller Fees of MVEGAS Company.

3. Consequences in case of impossibility to deliver Articles

If it is impossible to deliver an Item to the Buyer, in particular when the address entered is incorrect or the parcel has been returned for non-receipt by the Buyer, the Parcel is returned to the Seller according to the terms provided for by the selected carrier.

4. Commitments and obligations of the Seller

The Seller undertakes to sell only Items of which it is the sole owner or, in the case of a consignment sale of second-hand Items, on behalf of a person who is the owner of the Items. The Seller ensures that it does not in any way contravene the laws and regulations in force or infringe the rights of third parties by submitting an Article Sheet to MVEGAS Company or by offering an Article for sale via the Site.

The Seller guarantees (i) that the origin, condition and characteristics of the item it offers on the Site comply with the description given in the Item Sheet and (ii) that the Item offered at the sale is not an Infringing Item.

At the first request of MVEGAS Company, the Seller must provide it with all the documents likely to justify its rights of ownership over the Item offered for sale and/or its origin. MVEGAS Company reserves the right to delete the Profile Sheet and/or the Article Sheet of a Seller in the event that he does not validly justify his rights of ownership over the Article(s) referenced with MVEGAS Company and/or the origin of this/these. The Seller cannot claim any right to compensation in the event of deletion of this information by MVEGAS Company for the reasons mentioned above.

The Seller is solely responsible for the sale of an Article. In particular, he will refrain from selling any Item which would be the subject of a sales ban that would contravene the laws and regulations in force and/or would infringe the rights of third parties.

In this regard, and in particular, the User is prohibited from selling prototypes (clothing or accessories made before their launch in series) or uniforms (clothing or accessories intended for employees of certain brands) or even some of the Articles from " staff sales" or "press sales" whose resale would not be authorized, it being specified that MVEGAS Company is not in a position to verify whether such a prohibition is applicable or not.

If MVEGAS Company were to become aware that one of the Articles mentioned above is offered on the Site, the Article Sheet of the article concerned and/or the Seller's Profile Sheet may be automatically deleted( s), without the latter being able to claim any right to compensation.

Once a Seller's Item Sheet has been put online, the Seller must regularly connect to his account in order to know the list of Transactions in progress and monitor them. If the Seller cannot log in and monitor his account for an extended period, he must notify potential buyers of an extended processing time by clicking on the "SELLER'S HOLIDAY SETUP" button directly in the Item Sheet of the item concerned. He will be able to resume, on his return, the sale of Articles by clicking on this same button.

5. Seller Fees

The services offered by MVEGAS Company are remunerated by “ Seller Fees ” equal to 20% that MVEGAS Company deducts from the Price of an Item paid by the Buyer.

The Seller Fees collected by MVEGAS Company correspond to the amount paid for each Transaction to MVEGAS Company by the Buyer in consideration in particular for intermediation services between the Seller and the Buyer. These Seller Fees are integrated into the sale price at which the Article is presented on the Site and specified upon acceptance by MVEGAS Company of the Article Sheet created by the Seller.

It should be noted that the adoption of a new scale does not give rise to any reimbursement for Transactions concluded previously (for example, if the Seller notices a difference between the amount of the Seller Fees paid previously and the Seller Fees based on a new scale).

6. Sale of Items and Payment Due to Seller

6.1 Process of sending and direct delivery of the Articles by the Seller to the Buyer

Sellers deliver the Items directly to Buyers, under certain conditions.

The Seller whose Item is the subject of an Order by a Buyer receives a notification of this sale by email informing him that the Item must be sent to the Buyer. The e-mail contains a prepaid shipping slip allowing the Seller to send the Item to the Buyer free of charge.

Sellers must obtain proof of shipment for each package sent to Buyer.

The Seller must endeavor to send the Item by the carrier assigned to him (after having printed the prepaid dispatch note) within seven (7) calendar days following the confirmation of the sale, except in the case of pre-order period for the Article mentioned by the Seller in the Article Sheet. No object other than the Article and the accessories sold with the Article must be sent, and in particular any advertising material in any form whatsoever.

MVEGAS Company shall not be liable to the Seller for any damage to any Item or loss of any Item while being shipped to the Buyer if the package is shipped without the prepaid voucher.

In any case, the Seller will be responsible for respecting the delivery times which will be brought to the attention of the Buyer when placing his Order.

State of the Items on delivery

In any event, the Seller undertakes to deliver perfectly clean Articles (ie Articles that have been cleaned and ironed if necessary). In the event of a complaint from a Buyer following the delivery of an Item in poor condition, and after examining the Buyer's request, MVEGAS Company will inform the Seller, if applicable, that the Item will soon be returned to it.

6.2 Seller Payment

The sums received from the Buyer, from which will have been deducted: (i) the Seller's Fees which accrue to MVEGAS Company and (ii) the shipping costs, are fully paid to the Seller by MVEGAS Company, after confirmation of the conformity of the Article in the Article Sheet by the Buyer and following confirmation of receipt of the Article by the Buyer in compliance with the legal period of fourteen (14) calendar days provided for in Article L 121-21 of the Code of consumption, in the event of the return of an Item from a Professional Seller.

In the event of modification of the scale of Seller Fees, the offers in progress on the day of its entry into force will become null and void.

However, after delivery of the Article to the Buyer, the Seller must reimburse, at the first request of MVEGAS Company, the sums received from MVEGAS Company under the Transaction and reimburse any shipping costs to the Buyer, when the Item is infringing or has been banned from sale in violation of Seller's obligations.

If MVEGAS Company has not paid any sum to the Seller under the Transaction, the Seller will not be entitled to any payment for an Item which would have been validly returned by the Buyer.

The Seller expressly waives the right to claim the benefit of sums (interest or other) possibly produced by the temporary immobilization of the amounts received by MVEGAS Company on the occasion of the Transaction.

In the event that the Seller wishes to be paid by bank transfer, bank transfers are made to the bank account designated by the Seller. They are carried out by MVEGAS Company within fourteen (14) days of confirmation of receipt of the Item by the Buyer. If he opts for payment by transfer to his bank account, bank charges may apply, in particular for accounts domiciled in countries other than France. The terms and conditions applicable to these transactions should be consulted with the bank holding the bank account concerned.

In the event of a claim or complaint from the Buyer, MVEGAS Company reserves the right not to make any transfer to the benefit of the Seller until said claim and/or complaint has been resolved.

It should be noted that the sums transferred may not be immediately credited to the Seller's bank account or PayPal account, due to the taking into account of a technical delay between banks of approximately five (5) working days, these deadlines being specified for information only.

In the event that a Seller does not pay the sums due to MVEGAS Company, MVEGAS Company may on its own initiative, and after having informed the Seller in writing, (i) offset the sums remaining due with the sums it is expected to pay back to said Seller, and/or (ii) withhold the Items purchased or sold by the Seller, until full payment of the sums due, and/or (iii) allocate in priority the sums it receives from time to time a new Transaction on the sums remaining due.

In order to obtain his payment, the Seller must provide bank or PayPal information on his customer account so that MVEGAS Company can make a transfer to his bank account. It is specified that the surname and first name must correspond to those of the bank account so that the transfer is authorized by the bank concerned. It is the sole responsibility of the Seller to ensure the accuracy of the banking information he enters and MVEGAS Company cannot be held responsible in the event of an error. If he opts for payment by transfer to his PayPal account, PayPal fees may apply.

By using the services of MVEGAS Company, the Seller accepts the general conditions of Stripe and Paypal (Hyperwallet) which is the payment provider retained by MVEGAS Company for the payment transactions of sellers.

Sellers sell their Items on the Site in Euros.

6.3 Presence on the Site of Counterfeit Items or Items Subject to a Sale Ban

MVEGAS Company applies the procedures of the Anti-Counterfeiting Charter on the Internet for the benefit of consumers and rights holders.

Sellers guarantee that the Items they offer for sale are not counterfeit or are not prohibited from sale. If, however, despite the care taken in the physical control of the article, a Buyer should receive a counterfeit or an Article subject to a ban on sale, he may return it to MVEGAS Company and obtain a refund.

In the event that an infringing or prohibited Item is discovered, it will be immediately removed and the Seller's account may be temporarily or permanently suspended.

Furthermore, in the event that an infringing Article or the subject of a ban on sale would be put up for sale on the Site, the Seller of this Article would assume the risk that this Article be seized by the competent authorities or by the holder of the mark concerned, which could retain or destroy it. The Seller would then be personally responsible for recovering said Article at its own risk and expense.

In this respect, it should be specified that in accordance with articles L335-1 and following of the French Intellectual Property Code, counterfeiting is punishable by three years' imprisonment and a fine of €300,000 (€1,500,000 for Moral people). If the offense is committed by an organized gang, the penalties are increased to five years' imprisonment and a fine of €500,000 (€2,500,000 for legal persons).

In the event that an infringing Article or the subject of a ban on sale would nevertheless be offered for sale or seized by the competent authorities or by the brand owner of the intellectual property rights concerned or by the holder of the rights after having been sold, the Transaction would be cancelled.

In this case, the Seller must reimburse MVEGAS Company for any sums he may have received for the sale of the said Article and must compensate MVEGAS Company for all possible costs incurred by MVEGAS Company and/or the Buyer as a result of the activity of the Seller and must guarantee MVEGAS Company against any legal proceedings.

In addition, if the Item is not seized by the relevant authorities or the relevant trademark owner, MVEGAS Company will notify the Seller that the Item will be destroyed after a period of six (6) months, unless the Seller does not request it by contacting MVEGAS Company customer service and provide information supporting the authenticity of the item (to the satisfaction of MVEGAS Company).

In the event that the Sellers wish to recover their Item, they must make the request by contacting the customer service of MVEGAS Company and make a bank transfer of fifteen euros (€15), corresponding to the incompressible processing costs. After receipt of payment, MVEGAS Company will return the Item to the Seller within fifteen (15) working days.

In case of doubt on the authenticity of an Article, MVEGAS Company reserves the right to ask the Seller for any documents attesting to the authenticity of the said Article and to suspend the Seller's account until receipt of the said documents. MVEGAS Company also reserves the right to contact the Sellers of the Articles in order to verify, if necessary, the authenticity of an Article.

7. Ownership of Items and Risks

The Articles remain the property of the Seller. The transfer, for the benefit of the Buyer, of the risks of loss and deterioration of an Article sold to the Buyer occurs at the time of receipt of this Article by the Buyer or by a third party that the Buyer has delegated. The Buyer will therefore be held responsible for any damage caused to the Article by his fault after receipt.

8. Complaints and returns

8.1 Non-receipt and late delivery of an Item

If the Buyer does not receive his Articles within thirty (30) days following the date of the Order (except in the case of a pre-order period for the Article mentioned by the Seller in the Article Sheet), he benefits from the possibility to cancel the Transaction provided that he has previously ordered MVEGAS Company to remedy the situation within a reasonable time and that the delivery has not been made within said additional time.

MVEGAS Company will reimburse the Buyer within a maximum period of fourteen (14) calendar days from the date of receipt by MVEGAS Company of the notification of the information of the cancellation of the Transaction by the Buyer.

Note that if the Buyer receives his Items when he has already canceled the Transaction, he must return the Items to the Seller and MVEGAS Company undertakes to reimburse the Price of the returned Items, the shipping costs (in the event return of the entire Order) and return costs for the return of the Order to the Seller, within a maximum period of fourteen (14) calendar days from the receipt by the Seller of the complete Items and in their original condition. of origin. These returns must be made in accordance with the terms of Article 8 below.

In the event of cancellation, the Buyer will obtain a refund in cash (amount credited to the card used for payment or to their PayPal account), provided that, in each case, MVEGAS Company does not consider that the request for cancellation or refund for total or partial non-receipt of an Item ordered has been made fraudulently. In the event of partial cancellation, only the part of the canceled Order will be refunded under the aforementioned conditions.

8.2 Items not compliant with the Item Sheet

It is specified that the intervention of MVEGAS Company in the context of complaints following a purchase made from a Professional Seller is only for the purpose of facilitating the said procedure and does not make MVEGAS Company a party to the sale. .

Finding of non-compliance upon receipt by the Buyer of Articles

  • (i) Item sold by Non-Professional Sellers:

In case of option of sending the article directly by the Seller:

In the event of non-compliance of an Article with the description which has been made of it in the Article Sheet noted by the Buyer, the latter must contact MVEGAS Company by email within a maximum period of seventy-two (72) hours from from the date of receipt of the article.

The Buyer must explain to what extent the Article does not correspond to the Article Sheet and provide photographs to support his assertions.

If the complaint for non-compliance of the article with the Article Sheet seems a priori founded on the basis of the Buyer's explanations and the photographs, MVEGAS Company will authorize the Buyer to return the Article to the Seller. MVEGAS Company will reimburse Buyer upon Seller's confirmation of receipt. Any reimbursement will take the form of a payment credited back to the initial means of payment used by the Buyer.

  • (ii) Items purchased from a Professional Seller

In the event of non-compliance of an Article with the description which has been made of it in the Article Sheet, the Buyer has the right to file a complaint with the Professional Seller through the intermediary of MVEGAS Company in accordance with the legal guarantees.

A complaint invoking the lack of conformity of the article with respect to the description of the Article Sheet entails the obligation for the Buyer to return the Article.

The Professional Seller acknowledges that if an Item is returned by the Buyer because of its non-compliance with the description of the Item Sheet or because it does not meet the legal obligations of the Professional Seller, the Professional Seller may not refuse to apply the methods described above and must act within a reasonable time.

If the Buyer believes that he has received a counterfeit or an Item that is the subject of a ban on sale, he must alert MVEGAS Company by email within a maximum period of seventy-two (72) hours from the date of receipt of the article and may return the Article to MVEGAS Company and obtain a refund, except in the case of fraud on its part.

The provisions of this article in no way make MVEGAS Company a party to the sale between the Seller and the Buyer. MVEGAS Company's liability is excluded in the event of a breach by a Professional Seller or a Non-Professional Seller of its obligations under this article 8 and in particular in the event of a breach by the Seller of its obligation to provide a refund or other remedy for an Item returned by the Buyer due to its non-compliance with the Item Sheet, counterfeiting or sale of an Item prohibited from sale.

8.3 Special provisions when the Seller is a professional

 

Professional seller status

All Professional Sellers must declare themselves as such on the Site. MVEGAS Company recalls that Article L. 132-2 of the Consumer Code prohibits and punishes misleading commercial practices, in particular that which consists of "falsely asserting or giving the impression that the professional is not acting for purposes that fall in the context of his commercial, industrial, artisanal, liberal or agricultural activity or to present himself falsely as a consumer” (article L. 121-4 21° of the Consumer Code). Such practices are punishable by two (2) years imprisonment and a fine of 300,000 euros. The amount of the fine may be increased to the benefits derived from the offence, to ten percent (10%) of the average annual turnover calculated over the last three years or to fifty percent (50%) of the expenses incurred for the realization of the advertising or practice constituting that offence.

When registering on the Site or even later if he changes status after registration, the Professional Seller must therefore indicate to MVEGAS Company that he is acting as a professional. MVEGAS Company will then notify the Users.

General obligations of the Professional Seller

The Professional Seller (including MVEGAS Company when it offers its own Items for sale directly to Users on the Site) guarantees the proper performance of its legal obligations regarding the sale of Items to non-professional Buyers, and undertakes notably :

  • not to commit an act or omission likely to mislead the Buyer, so that the Buyer buys an Item that he would not normally buy;

  • to respect the right of withdrawal of the non-professional buyer as provided for by the applicable legislation as well as any other rights that the Buyer may have (if applicable) under the applicable legislation, and in particular under the legal guarantees; And

  • that any Article that he puts up for sale on the Site complies with the description he has given in the Article Sheet, is of satisfactory quality and is suitable for the use indicated by the Professional Seller in the description or for any use for which this Article is usually intended and, unless otherwise stated, is free from any material, design or manufacturing defect and to guarantee the Buyer accordingly under the legal guarantee of conformity and that relating to hidden defects.

In addition, the Professional Seller will be responsible for all useful declarations to the administrations concerned to comply with the applicable regulatory provisions (in particular its obligation to register).

MVEGAS Company draws Sellers' attention to the fact that Sellers who regularly perform acts of sale and/or sell a large number of Items may be qualified as professionals by the tax authorities or other authorities and may therefore be subject to the obligations applicable to Professional Sellers under the applicable regulations and these General Conditions. It is expressly specified that it is the responsibility of the Users to respect all the obligations incumbent on them, including the useful declarations with the administrations concerned to comply with the applicable regulatory provisions, MVEGAS Company assuming no responsibility in this regard. .

MVEGAS Company reserves the right to ask Professional Sellers to provide it with any documentation confirming their identity and address (particularly in the case of French Sellers: a K-bis extract or an identity card, a SIRET/ SIREN, a bank account number in France), in order to be able to verify and keep the information relating to the identity of the Professional Sellers and their contact details as well as the identity documents for the entire duration of the opening of an account and for five (5) years following the closure of an account.

Return of Items

The Professional Seller acknowledges that if an Item is returned by the Buyer due to its non-compliance with the description of the Item Sheet or because it infringes these General Conditions and/or the legal obligations of the Professional Seller, the Professional Seller may not refuse to reimburse the Article to the Buyer, to repair the Article (if this is reasonably possible) or, at the option of the Buyer, and in each case within a reasonable time.

If a Transaction is canceled within the framework of the exercise by a Buyer of his right of withdrawal or in the event of lack of conformity of an Article, counterfeit Articles or Articles subject to a ban on sale and that the Seller wishes to have the Item that is the subject of the canceled Transaction returned, he must inform MVEGAS Company within a period of six (6) months from the date of cancellation of the Transaction. The Seller must then pay MVEGAS Company a lump sum of fifteen (15€) euros for a non-compliant and/or infringing Article corresponding to the incompressible processing costs (costs relating to the shipment of the article to MVEGAS Company and costs relating to the return of the item to the Seller) and must reimburse MVEGAS Company for any sums it may have received in respect of the sale. In this case, the Seller will have a period of six (6) months from the written notification to claim the Article and pay the penalty of fifteen (15€) euros to recover the Article indicating a specific reason to MVEGAS Company . The absence of payment of the penalty within this period will automatically be worth authorization granted to MVEGAS Company to dispose of the article in the manner it deems necessary.

Classification of Articles on result pages

Default referencing: the Articles are classified, by default, according to a selection by our editorial teams which takes into consideration the following elements: price, category (Men/Women), category of Articles (leather goods, accessories, clothing, jewelry , vintage), representativeness of the different brands.

Personalized referencing: Buyers can choose another criterion which will determine the sorting of Articles according to the following sorting criteria:

- "most recent", "least recent": Articles are sorted according to the date of creation of their file on our platform;

- “the cheapest”: the Items are sorted from the cheapest item to the most expensive Item;

- “the most expensive”: the Items are sorted from the most expensive item to the least expensive Item;

General provisions

9. Duration and validity

The User is subject to these General Conditions from their acceptance when accessing the Site or from registering on the Site and until the deletion of their account, whether or not they carry out Transactions.

MVEGAS Company reserves the right to modify its General Conditions at any time, without notice or obligation to justify its decision and without its liability being incurred as a result. In the event of a substantial change to one of the conditions of these General Conditions, Users who have previously accepted their terms must accept the new version of these General Conditions. The applicable General Conditions are those in force on the day of use of the Site by the User and/or the purchase of an Item depending on the nature of the modification made to the General Conditions.

10. Interruption of Service and Termination

In the event of non-compliance with one of the conditions of these General Conditions (and in particular in the event of non-payment on time or breach of these General Conditions), whether it is noted by MVEGAS Company, or that it is the subject of a justified complaint from other Users, MVEGAS Company may temporarily interrupt the access of a User or a Seller to the services of MVEGAS Company, in particular in order to allow a possible regularization of the disputed situation .

When the failure is reparable and if this regularization does not occur within two (2) calendar days from the notification, by MVEGAS Company, of the irregularities noted, MVEGAS Company may automatically close access to the 'User concerned to the services. This permanent closure of access will be preceded by the sending of an email to the User concerned informing him of this measure and the reasons behind it, without further formalities and without prejudice to the compensation that it could claim compensation for any damage it may have suffered.

In addition, MVEGAS Company may terminate automatically, without prior notification and with immediate effect, the services provided if the behavior of the User seriously contravenes these General Conditions and, in particular and without limitation, in the following cases : opening of several accounts, means of payment fraud, attempted fraud or any other criminal offence. Such a measure will not entitle MVEGAS Company to any compensation of any kind and the latter will reserve its rights to compensation for any prejudice it may have suffered.

In the event that MVEGAS Company cancels the Transaction(s), the User will automatically be reimbursed in cash (amount credited to the initial means of payment that he used).

11. Complaints

Any User wishing to file a complaint with MVEGAS Company concerning the use of the Site may send a letter to MVEGAS Company at the e-mail address: seller@circularclothingparis.com .

12. Applicable law and competent jurisdiction

These General Conditions are governed by French law.

In the absence of an amicable solution to the dispute between them, MVEGAS Company and the User agree to submit the dispute in question to the jurisdiction of the French courts. The terms of this article shall not have the effect of depriving consumers of the right to take legal action, or to defend themselves therefrom, in the country where they are resident or domiciled, nor of depriving them of the measures of protection provided for them by the legislation applicable in their country of residence.
